well, they tow cars by picking up the drive wheels so for your m3, they will pick up the back and with out a doubt, cause some damage to your poor M technik front spoiler as it scrapes the ground on the way to the impound yard. so no, your parking brake doesn't have to be released.

but i don't see how towing the car this way is any better for the car when compared to towing it on a flatbed. twice, i had to have my car put up onto a flatbed tow truck and both times, my front spoiler snapped and foglights cracked when on its way up the ramp. arggh... on my third spoiler now.
