Of course, don't take the situation lightly, but let him know that you've seen this problem several times on this forum and that it's common to chase it around a time or 2 before it's fixed. Maybe even offer to show him the forum, if he's not a user already.
As far as the rental car, find out the general policy of the dealership and if cars are routinely available. If you mention to the SM that the M3 is your only convenient ride and they can hang on to your M3 for a few days to make sure the problem gets fixed, I'd bet that the SM offers a rental car (but it's probably is a Saturn).
Bottom line, hardball (bitching) is a last resort, a missed shift (look at the archives) and you want this guy on your side.
