The price seems right. It's tough to find a '97 M3 with 55k for a price like that. Besides, you've seen and hopefully driven the car, so it's not like you're buying from someone across the country with an "online" special. What kind of dealer is it? Some sketchy used car lot? What other cars do they have in their inventory? Like I said, $25,996 is a good price, and $995 is decent for a 3/36 warranty (I think BMW charges $1500-$1700 for a 2 year/50k extension).

If you really like the car, then do what the other poster suggested. Spend $150-$250 and have a independent BMW mechanic look over it. He'll know what to do with it (check for any previous damage, VIN, etc, etc, etc). I'm sure if you ask the forum, someone could recommend a decent mechanic in the Philly area. In addition, if you bring the VIN number to a BMW dealer, so they give you the car's service history (noted on another post).

Tons of people change their intake. Maybe it's a mod...Dinan or something. That's really no problem. If it's registered for commercial use, it was probably a company car, or even a rental car. Again, I'm sure a good mechanic will make life easier for you by telling you what condition the car is in. A car can look mint, but you HAVE to get it checked out by a mechanic.

As for your bike, you can get a rear hitch. I live in the bike capital of the world (it seems), and I see rear bike hitches on M3s, Mercedes, Miatas, you name it. And I think you can pop your rear seats down and place your skis inside through the trunk. I also have a Thule roof rack (not on my M), and it takes about 5 minutes to pop on and off. They seem to make their roof racks for all cars. Maybe check their website.

I guess you're not going to take up my suggestion on $26k for a new, mod, kick-ass A4 :). But I'm a M3 owner, and I understand completely. An M3 is an M3. Good luck with your buying adventure.
