Driveshaft dampener issue.... (archive)

I took my M3 in for a clunking sound when shifting and
some notchiness in the transmission when shifting, and they
came up with the "Gevou" (Pronounced "gee vo") on the
driveshaft was rotted and cracked. Supposedly this is the
same as a universal join on a regular car/truck. Has
anybody else ever had this as an issue on their M3? Is
the dealer just blowing smoke? My extended warranty is
trying to deny the claim on it because they say that it is
a "pre-existing" condition with the car. I just got the
warranty a couple of months ago and have put about 2500
miles on the car since the warranty was purchased. What
kind of case or recourse do I have against these warranty
folks that are trying to deny this claim?

If anybody has any help or advice, I'm all ears!
