I don't think it will actually hurt the engine, but chances are you are probably losing some performance.

The HFM takes a sampling of the air flowing through the intake and adjusts the engine management software accordingly. Because the stock software doesn't know its a 3.5" it assumes that it is the 2.5". More air is actually going through the intake than the software expects.

You should see a dramatic improvement once you get the conforti software. I agree the sound alone is worth the install.
