Even if they could return the vehicle to "like new" the fact is, it's been in an accident, will have an insurance claim against it, and will always have less resale value than the same car which has not been in an accident. Effectively, the car has suffered a permanent loss of value, how much could/would be debated forever, so it would be better to just replace it.


I have to agree with the fact it will no longer have any resale value to it as a mint car. One of my E36 M3's was damaged back in January of 99 with it only being 90 days old and I had to fight for a total. They ended up not totally in the car and fixed it. It took about 6 months to fix and costed the insurance company $24K to repair. Half way through the work the adjuster finally admitted after seeing how much work had to be done that they should have total the car. After I got the car back I got rid of it and sued the insurance company for the lost depreciation and did win. Insurance adjusters need to be better educated.
