I just received this e-mail from a 2001 ///M5 owner. I'm very happy about what he wrote about my car. =)
Here is my quesiton..... Do you think this person might have gotton a Lemon and could this case be applied in the State Lemon Law?

By dumb luck (Yahoo search), I found it last night. Your site has been of great help to me.
Over the past 4 years we have purchased 6 new BMWs: Z3, M roadsters, 528i, 740il and we just got (4 weeks ago) a 2001M5.
All was well in BMW land for the first 800 miles of the M5s life. At 800+ miles the transmission started making banging and clanking noises when the clutch was engaged or disengaged at low speeds.
I took the car to the dealer and they replaced the tranny with a rebuilt trans (much to my anger). The 'new' trans is louder than the original !
I met with 2 levels of BMW service reps and they told me that there was nothing that BMW could or would do about the problem.
After doing a bunch of research, I discovered that the M5 is really nothing more than a 504i with some work done to the 4.4 liter 540 engine. Most likely bored out a little to achive the 4.9 liter specs. The trans is the 540i 6 speed and cannot handle the additional tourque load of the M5 engine.
I saw the oil that was in the first trans. It looked like a silver pearl paint. The gears and bearings are just getting ground up by the tourque of the engine.
We love BMWs so we are trading the M5 in and ordering a 2001 540i sport with the steptronic. Your web site has been a real eye opener to us. You have demonstrated that you can take a stock 540 and turn it into a faster, stronger car than the M5 for about the same investment.
Any suggestions that you might have to make concerning our project would be greatly appreciated !
