Did not realize you were looking for information on Lemon Law.
This guy's dealership is definitly giving him a run-around. Trading to a 540 is not going to make things any better if they cannot correct things on the first vehicle. It may even make things worse!
He should find another dealership (if available) ASAP and have them look at the problem.
Most Lemon Laws require documentation of the problem and (repeated) attempts at repair. He need's to be sure and save all his paperwork from all of his visits. This will make things easier if he needs to enact any Lemon Law statute. Do not trust the dealership to keep all of these records as things can suddenly disappear when there's trouble.
