Your dealer should fix it without too much argument, and at NO COST to you. Believe me when I tell you you're not the first clutch failure you dealer has seen. DO NOT AGREE to pay for the repair, as it will set a dangerous precedent. Keep fighting it if they indicate you are responsible. It IS a design flaw.
Search this board, and bmwm5.com for others who have experienced the clutch failure. There is an electronic petition being floated around by Faisal in NY. Search this board going back a few weeks for the link to add your name to the petitioners.
Mine went at 11,700 miles. My dealer, Wagner BMW in Boylston, MA took very good care of me. BTW - My car is for sale, and Wagner has it on consignment. If anyone is interested in a nice 2000 M5 (with a new clutch!), call Fred Buckley at Wagner. The number is 508-869-6766 x 243.
