You are entitled to a new car if BMW can not fix the car to 100% condition of how it came from the factory. Now I am no genius but I think that reparing anythhing that was on fire to the same condtion that is was in when it left the factory is impossiable.

Contact BMW AG and BMW NA as well as the insurance peoples number that BMW AG gave you.
