When purchasing my '02 M5 last month dealer said the M5 was not eligible for ext. warranty. They had recently changed owners, and up untill a week before delivery thought the warranty available. Any others in this situation? What's my next course?

If you purchased it privately, it is not able to be Certified Pre-Owned. If you purchased it at a dealer, you should find out what disqualified it as CPO (e.g. maybe extensive previous damage, etc).

extended warranty you can purchase from BMW on a new car (except I think 3yr-36K mi maintencance might be able to be extended a bit for an extra fee). You could purchase an extended warranty from a number of companies but these typically don't pick up any repairs until the remaining factory warranty has expired. So, no point in investing in that until just before your BMW expires. Note: It's usually somewhat cheaper if you buy an extended warranty before the factory warranty expires.
