I got my X5 from an out-of-state dealor. My lender in coordination with the dealor took care of the title/CA DMV registration. I called CA DMV prior to finalizing the deal and was told that a smog check is not needed on a NEW vehicle that meets emission requirements. All out-of-state used vehicles will require a smog check. I currently have an out-of-state tag while waiting for my CA plates.
