Hi Mr. Scottsdad,

I am part of the BMW New Zealand team and we are still waiting for our first major shipment of these X5 vehicles to come into the country. If a problem like that was to occur causing any type of discomfort to our customer we would gladly fix or even replace the seat under warranty. I'm sure your local BMW dealer would have the same opinion, try them.
