My X5 has air bubbles on the driver's side..... (archive)

I picked up my x5 three weeks ago and I just noticed last week that there are air bubbles on the driver's side. I took it to the dealer and the directed me to a outside body shop for warranty work. The manager at the body shop tells me that the air bubbles are a result of dirt and that it appears the side was repainted. I ask the dealer if the car was damaged during delivery or production, but was told they know nothing. Do I have an legal grounds to sue bmwna for this deception. CA los angeles
