Unfortunately you're correct. Per the BMW v. Gore url I posted earlier:

"In California, for example, the disclosure statute defines "material" damage to a motor vehicle as damage requiring repairs costing in excess of 3 percent of the suggested retail price or $500, whichever is greater. Cal. Veh. Code Ann. §9990 (West Supp. 1996)."
