Tell the insurance company you do not want the wrecked or repaired X5, since it was such a new vehicle, and are going ot purchase a new one. You can't get replacement value, only Actual Cash Value (ACV) of your X5 immediately prior to the accident. Tell them that you either want the ACV of the vehicle prior to the accident, or you will immediately sell or trade in the repaired vehicle and they will need to make up the difference for the wrecked-and-repaired value which is lower the the value of an unwrecked X5. if you sell, you should be able to get NADA retail value. If you trade in, you should be able to get the NADA trade-in value. I bet they will just write you a check for the ACV, and take possession of your car. Don't sign anything about injuy, whether or not your feel you were hurt, until you are completely satisfied with the outcome. Sounds like your requests are reaonab;e and fair. Keep them that way, and try to work nicely with the insurance company, and you should be OK.
