There was a very famous case in Alabama regarding this very subject. I believe it was a doctor who bought a brand new 740 if memory serves be correctly. It had been damaged or dented or wrecked and repaired by the dealer. They sold it as a new car with no disclosure. When paint problems ensued, the fact the car was not factory new, and the good Dr. sued. BMW was found liable and had to open their wallet.
