: There was a very famous case in Alabama regarding this very subject. I believe it was a doctor who bought a brand new 740 if memory serves be correctly. It had been damaged or dented or wrecked and repaired by the dealer. They sold it as a new car with no disclosure. When paint problems ensued, the fact the car was not factory new, and the good Dr. sued. BMW was found liable and had to open their wallet.
I am not sure what the car was for sure, but I wam thinking it was a 535. WHatever it was it really doesn;t matter. The jury awarded him millions of dollars, but was reduced on appeal. The doc got some money but it was not a lot.
