The body shop was acting at the behest of BMW. I authorized BMW to affect the repairs. Neither I nor the insurance company selected the body shop.

I contracted the ins. co. to "cover" me. The insurance co. paid BMW for all the work. BMW paid the body shop. In good faith, I authorized BMW to affect the repairs. BMW accepted the work by the body shop as satisfactory. When BMW contracted the body shop, the body shop became, for a short period of time, a BMW "employee." BMW is responsibility for the actions of its employees, both permanent and contracted.
