Many have reported this problem, including me. The "fix" involves cutting the carpet behind the passenger's seat. Most dealers won't tell you that they're going to do this.

They replaced my sending unit and the problem didn't go away. I don't think BMW has solved the problem yet. My advice is to wait, and live with it. You can search the archives for more storied.
