didn't we come to the conclusion that the speed limiter was in-active when the car was on the dyno due to it being "confused" by the condition that the car was in - i.e. the front wheels not turning at all & the rears spinning to beat the band ??
I recall someone explaining how this happens, but not exactly.
having said that, I also recall that I have read that you cannot get a good dyno test of an E39 M5 in 6th gear due to the speed limiter kicking in. I think that since the M5 has the more sophisticated DSC as opposed to the (relatively) simpler traciton control that we have on our M/Z3's it likely allows for the dyno situation for some reason.
I'll assume that the limited is there & maybe I'll hit it at the track next summer. in the meantime I'll keep the ASC on & watch out for the snow.
