My original "shocks" were slowly leaking oil - I could see the film every time I washed the car - so I had them replaced under warranty. If enough of the oil leaks out, there won't be enough pressure to hold the hatch open.

But it is sensitive to temperature. When the temp drops into the 30s or 40s here in San Diego (brrrrrrr and grinning), the hatch definitely closes much easier than when it is warm.
