If you have a standing order& deposit for the car, you can always sue the dealer, get an injunction to force him to honor the contract.

At least he is having an auction. Most dealers are just listing them at 250k. My dealer is charging 180k even though I have a buyers order w/deposit at 130k. Theres not much you can do even if you want to call BMW, knowing you could always sell it at 210-230 the dealers figure you'll still buy the car and if you dont someone else will. It's really poor management on BMW's part because I am sure they have received many complaints and they could easily divert the cars to other dealers or threaten to pull dealerships.

I'm a BMW Salesman whose employer is holding a sealed bid auction on its one Z8 allocation this year. The car is silver/black and will be produced in September. I am accepting SEALED bids on this vehicle starting at $200,000.oo. A $10,000.oo deposit is required to weed out pretenders. Of course all transactions will be through the BMW dealership--you are not buying someone elses place in line or anything strange like that. Bids will remain sealed until the car is on the showroom floor. (I'm sure there will be some kind of "unsealing party" or something like that) All unsuccessfull bid deposits will then be quickly refunded.
