I'm fairly certain this is how this went down: This guy has had a deposit at this dealership in upstate NY for over a year now. Dealer tells the guy MSRP. When the car finally comes in, the price jumps to $150,000. After complaining the price falls into the 140,000's. Of course the guy never got anything in writing about the price, so they can do anything they want. Turns out the guy found one the same color in this week at MSRP from a very nice dealership located just around the corner from him. I'm also fairly certain that the guy DID get the deposit back ($5000). If he didn't get it back he should call BMW customer service because no authorized dealer should be able hold a deposit in this situation. It's not as if they spec'ed a car out for him. For god sakes there are no options, and silver on black is not exactly an unsellable combo, if you know what I mean. Logic follows that If they didn't have the price in writing, then they probably didn't have the deposit as "non-refundable" in writing either. Even If they did, he has the right to have it back. I've never even heard of a dealership keeping a deposit. Botton line is, original customer is happy, and NY dealer is sitting on a ton of floorplan, especially for such a small dealer.
